1. Introduction

Welcome to PDFWoohoo.

This Privacy Policy explains how information is handled when you visit or use PDFWoohoo.com, the PDFWoohoo web application, and any related websites, subdomains, applications, services, software, products, platforms, brands and other digital properties operated under or in connection with PDFWoohoo (collectively, the “Services”).

In this Privacy Policy:

“PDFWoohoo”, “we”, “us” and “our” refer to the owner and operator of PDFWoohoo and the Services;
“you” and “your” refer to any visitor, user or other person accessing the Services;
“User Content” means any PDF, image, TIFF, text file, Markdown file, ZIP or CBZ archive, document, clipboard content, intellectual property, personal information or other material that you open, import, paste, process, manipulate, convert or export using the PDFWoohoo application; and
“personal information” includes personal information or personal data as defined by applicable privacy and data-protection legislation.

PDFWoohoo is based in South Africa. This Privacy Policy is intended to be consistent with the Protection of Personal Information Act 4 of 2013 (“POPIA”) and, where applicable, other privacy laws.

PDFWoohoo is intended to operate substantially as an autonomous, self-service website with limited routine involvement by its owner. The Services and their communications channels may not be continuously or regularly monitored. PDFWoohoo does not undertake to provide active supervision, technical support, security monitoring, incident investigation or individual responses except to the extent strictly required by applicable law.

Your use of the Services is entirely voluntary. You are free not to use the Services and must discontinue use if you do not accept this Privacy Policy, the PDFWoohoo Terms and Conditions, or consider the Services unsuitable for your security, privacy, confidentiality or other requirements.

By accessing or using the Services, you acknowledge that you have read and understood this Privacy Policy and the Terms and Conditions.

2. Relationship with the Terms and Conditions

Use of the Services is also governed by the PDFWoohoo Terms and Conditions, which are incorporated into this Privacy Policy by reference to the extent applicable.

This Privacy Policy principally explains:

how personal information and User Content are handled;
which information may be processed;
client-side processing and its limitations;
browser storage and third-party infrastructure;
privacy rights; and
privacy-related security considerations.

The Terms and Conditions principally govern:

voluntary use of the Services;
permitted and prohibited conduct;
intellectual property and copyright;
responsibility for User Content and generated output;
warranties and disclaimers;
assumption of risk;
limitations of liability;
indemnities; and
suspension, termination and dispute provisions.

The two documents must be read together.

If they address the same matter, they should be interpreted consistently wherever reasonably possible. If an irreconcilable conflict exists:

this Privacy Policy prevails regarding the handling of personal information; and
the Terms and Conditions prevail regarding permitted use, intellectual property, risk allocation, warranties, liability and indemnification.

Mandatory applicable law prevails over both documents.

3. Client-side processing and protection of User Content

A fundamental feature of the current PDFWoohoo application is that document and image processing occurs locally within your web browser.

When you select, drag, drop, paste or otherwise open files in the current PDFWoohoo application:

the files are read and processed on your device;
the files are not intentionally uploaded to, transmitted to or stored on a PDFWoohoo server;
PDF conversion, image conversion, page extraction, page ordering, rotation, division, stitching, duplication, preview generation, clipboard copying and download preparation take place within your browser;
generated output files are created locally and downloaded by your browser; and
PDFWoohoo does not intentionally obtain possession of, inspect, retain or create a server-side copy of your User Content.

This client-side design materially reduces the risk associated with storing your confidential information, personal information and intellectual property on a PDFWoohoo server.

Unless a feature expressly and clearly tells you otherwise, PDFWoohoo does not receive the contents of files you process using the current application.

You retain responsibility for deciding whether client-side browser processing provides sufficient protection for your intended use. Your responsibility for User Content and generated output is explained further in the Terms and Conditions.

4. Important limitations of client-side processing

Client-side processing does not eliminate every possible security, privacy or confidentiality risk.

Your browser, device, operating system, browser extensions, local network, internet connection, security software, downloaded third-party code, malicious software or another person with access to your device may affect the confidentiality or security of your User Content.

The application also relies on browser technologies and externally hosted software libraries. Your browser may connect to third-party content-delivery networks to obtain those libraries. Although the application does not intentionally send your working files to those providers, those providers may receive ordinary connection information such as your IP address, browser details, requested resource, referring page and the date and time of the request.

No statement that files are processed client-side constitutes a guarantee that information can never be intercepted, accessed, disclosed, corrupted or lost.

You are responsible for deciding whether your device, browser, extensions, network and working environment are appropriate for the sensitivity of the material you intend to process.

You should not use the Services to process highly sensitive, classified, privileged, regulated or confidential material unless you have independently determined that the Services and your own computing environment satisfy every security, legal, professional and contractual requirement applicable to that material.

The contractual allocation of these risks is set out in the Terms and Conditions.

5. Immediate cessation of use where illicit or suspicious activity is suspected

If you notice or suspect any illicit, unlawful, malicious, deceptive, unauthorised, compromised or otherwise suspicious activity relating to PDFWoohoo, the Services or any connected third party, you must immediately:

cease using the affected Service;
close the relevant browser page or application;
refrain from opening, processing, uploading, pasting or downloading further material;
avoid entering credentials or other personal information;
take whatever independent steps you consider necessary to protect your device, accounts, network, information and User Content; and
seek appropriate technical, legal, law-enforcement or regulatory assistance where warranted.

This requirement applies whether the suspected activity appears to originate from:

PDFWoohoo;
the website’s hosting environment;
a content-delivery network;
a third-party software library;
an advertiser or embedded resource;
your browser or a browser extension;
your device or local network;
another user;
an unknown party; or
any other third party.

You must not continue using the Services while relying on PDFWoohoo to monitor, confirm, investigate or correct suspected activity. PDFWoohoo may not be aware of the activity, may not monitor the relevant communication channel and may lack the information, access, personnel or technical capability required to investigate it.

Continuing to use the Services after becoming aware of suspicious circumstances is at your own election and risk and may have consequences under the Terms and Conditions.

6. Information we may process

Depending on the features you use, the following limited categories of information may be processed.

6.1 Information processed only on your device

The current PDFWoohoo application may process the following within your browser:

files and archives you open or import;
pages extracted from PDF or TIFF documents;
images and text read from your clipboard after you initiate a paste action;
text and Markdown content;
page thumbnails and previews;
page order and selection;
page rotations, divisions, stitching and other edits;
blank-page colours and dimensions;
generated PDF, image, TIFF, text, RTF, Markdown and archive output; and
temporary object URLs, rendered canvases, clipboard caches and other temporary browser data required to provide the application’s functions.

This information is not intentionally sent to PDFWoohoo’s servers by the current application.

Temporary working information will ordinarily be removed when you clear the workspace, close or reload the page, or close your browser. Some information may remain in browser memory, caches, temporary storage, downloads or other device locations until removed by you, your browser or your operating system.

6.2 Preferences stored in your browser

PDFWoohoo uses browser local storage to remember certain application settings and usage states. These may include:

selected download format;
multipage or single-page output preference;
ZIP or separate-download preference;
raster-output resolution;
vector or raster PDF-export preference;
page-fitting preference;
last selected blank-page colour;
visibility of title-bar panels;
user-tier settings;
developer-tool visibility settings; and
guest-use timing information.

These settings are stored locally in your browser. They are not, in the supplied version of the application, intentionally uploaded to PDFWoohoo.

You can remove these settings by using the application’s reset function, clearing site data in your browser or configuring your browser to remove locally stored data.

Removing local settings may reset your preferences and guest-use status. Rules concerning user tiers and attempts to circumvent access restrictions appear in the Terms and Conditions.

6.3 Technical and server-log information

Like most websites, PDFWoohoo’s web server, hosting provider, security services or content-delivery systems may automatically receive or record technical information when you visit the Services, including:

IP address;
approximate location derived from an IP address;
browser type and version;
device and operating-system information;
language and time-zone information;
referring page or website;
requested URL;
date and time of access;
response status;
diagnostic, security and error information; and
other ordinary HTTP request information.

This information may be generated automatically as part of delivering and operating the website.

Technical logs do not ordinarily include the contents of files processed locally in the PDFWoohoo application.

The existence of technical logs does not mean that PDFWoohoo actively or routinely examines, monitors or investigates them.

6.4 Information you voluntarily provide

If you contact PDFWoohoo, submit an enquiry, report a problem or communicate through an available contact facility, information received may include:

your name;
your email address or other contact details;
your organisation;
the contents of your communication;
technical details you provide; and
files, screenshots or examples that you voluntarily attach.

Please do not send confidential documents, credentials, sensitive personal information or irreplaceable material through a contact channel.

Information voluntarily submitted through email, a contact form or another communication system is no longer confined to client-side processing and may be transmitted to and retained by the systems providing that communication facility.

PDFWoohoo contact channels may be unattended or checked only intermittently. Sending a message does not guarantee that it will be read, acknowledged, investigated or answered. The absence of a support or monitoring obligation is addressed further in the Terms and Conditions.

6.5 Account information if accounts are introduced

The current supplied application does not contain a user-login or server-side user-account facility.

If PDFWoohoo introduces registration, login, subscriptions, saved projects, cloud storage, payment processing or other account functionality in the future, information processed may include:

name and contact information;
username and account identifier;
encrypted or cryptographically hashed authentication credentials;
subscription and entitlement information;
account preferences;
login dates, IP addresses and security records;
billing or transaction references;
communications associated with the account; and
information deliberately stored through the new functionality.

This Privacy Policy and the Terms and Conditions may be updated if such functionality is introduced.

A new feature must not be assumed to use only client-side processing merely because other PDFWoohoo functions remain client-side. Users must read any notice and additional terms presented with the new feature before using it.

PDFWoohoo will not intentionally upload or retain working documents through a future account feature unless that feature indicates that server-side or cloud storage is involved.

7. Cookies and similar technologies

The supplied PDFWoohoo application uses browser local storage for application preferences and guest-timing information.

The wider PDFWoohoo website, its content-management system, hosting environment, security services, embedded content or future functionality may use cookies or similar technologies where necessary to:

provide core website functionality;
maintain a login session;
remember user choices;
protect the website against fraud or abuse;
balance traffic or maintain network security;
measure website reliability or performance; or
comply with legal requirements.

You can control cookies and site data through your browser. Blocking necessary storage may prevent parts of the Services from operating correctly.

8. Third-party software and content-delivery networks

The PDFWoohoo application uses third-party JavaScript libraries to provide functions such as PDF reading and creation, archive extraction, image rendering, GIF generation and TIFF decoding.

At the date of this policy, the supplied application requests certain software components from services including:

cdnjs.cloudflare.com; and
cdn.jsdelivr.net.

These providers may process ordinary technical request information according to their own privacy policies. PDFWoohoo does not control their independent systems, conduct or processing.

The current application code does not intentionally attach your imported files or file contents to those software-library requests. Nevertheless, no internet-delivered software can be represented as entirely free from supply-chain, network, implementation or third-party risk.

PDFWoohoo may change, add, remove, self-host or replace third-party libraries and infrastructure over time without individually notifying users.

If you suspect that a third-party library, provider, resource or connection has been compromised or is behaving illicitly, you must immediately cease using the affected Service.

Your assumption of third-party and software-related risks is addressed further in the Terms and Conditions.

9. Purposes for which personal information may be processed

Where PDFWoohoo receives or processes personal information, it may be used for purposes including:

providing and operating the Services;
receiving communications;
diagnosing faults where information happens to be reviewed;
maintaining the security, availability and integrity of the Services;
preventing fraud, abuse, unlawful access and malicious activity;
administering future user accounts, subscriptions or entitlements;
maintaining business, tax and transaction records;
enforcing the Terms and Conditions and protecting legal rights;
complying with legal and regulatory obligations; and
establishing, exercising or defending legal claims.

This list describes permitted purposes and does not represent a promise that PDFWoohoo continuously monitors, reviews, analyses or acts upon the relevant information.

PDFWoohoo does not intentionally use the contents of locally processed User Content for advertising, profiling, analytics, artificial-intelligence training or unrelated purposes because the current application does not intentionally receive that content.

10. Legal grounds for processing

Where a legal ground is required, personal information may be processed on one or more of the following grounds:

the processing is necessary to provide a service you requested;
you consented to the processing;
the processing is necessary to comply with a legal obligation;
the processing is necessary to pursue a legitimate interest, provided that the interest does not unjustifiably override your privacy rights;
the processing is necessary to protect a legitimate interest of you or another person; or
the processing is otherwise permitted by applicable law.

You may withdraw consent where processing is based on consent. Withdrawal will not affect processing that was lawful before the withdrawal.

11. Disclosure of information

PDFWoohoo does not intentionally sell or rent personal information.

Information may be disclosed to the extent reasonably necessary to:

website-hosting and infrastructure providers;
security, backup, maintenance and technical-service providers;
professional advisers;
payment and subscription providers if paid services are introduced;
authorities, regulators or courts where disclosure is required or permitted by law;
a purchaser, successor or participant in a legitimate business restructuring;
enforce the Terms and Conditions, protect legal rights or defend claims; or
another person where you expressly request or authorise the disclosure.

Because User Content in the current application remains on your device, PDFWoohoo cannot ordinarily access or disclose that User Content.

Third-party infrastructure providers may independently receive technical information through ordinary website requests.

12. International processing

PDFWoohoo is operated from South Africa, but service providers, hosting systems, content-delivery networks and other infrastructure may operate in other countries.

Ordinary requests for third-party software libraries may be routed through servers outside South Africa.

Where PDFWoohoo knowingly transfers personal information under its control across national borders, applicable legal requirements will govern that transfer. This statement does not constitute a guarantee concerning the independent conduct of third parties or internet-routing systems.

13. Retention

Information may be retained only for as long as reasonably necessary for its purpose, subject to legal, accounting, security, dispute-resolution and enforcement requirements.

Relevant considerations include:

locally processed User Content is not intentionally retained by PDFWoohoo;
browser preferences remain on your device until you or your browser deletes them;
communications may remain in the systems through which they were received;
technical and security logs may be retained by PDFWoohoo or its infrastructure providers;
future account information may remain for the duration of an account and for a reasonable period thereafter; and
information may be retained where required by law, relevant to legal proceedings or reasonably necessary to enforce the Terms and Conditions.

PDFWoohoo does not undertake to perform individual, manually supervised or immediate deletion exercises except where required by applicable law and practically possible.

14. Information security

The current client-side design reduces PDFWoohoo’s possession of User Content by avoiding intentional server-side uploading of working documents.

Other information may nevertheless pass through or remain within website-hosting, communication, account or third-party systems.

No website, browser, device, network, content-delivery system, software library or storage system can be guaranteed to be completely secure. PDFWoohoo does not guarantee that the Services will be continuously monitored, invulnerable, uninterrupted, free from malicious interference or capable of detecting every security incident.

PDFWoohoo does not undertake to:

continuously monitor the Services or relevant infrastructure;
review security or access logs routinely;
detect suspicious conduct on behalf of users;
investigate reports or suspected incidents;
trace malicious parties;
recover compromised User Content;
examine a user’s device, browser or network;
provide security support or forensic services; or
supervise independent third-party providers.

These limitations do not remove any non-excludable obligation imposed on PDFWoohoo by applicable law.

Every user remains responsible for monitoring and protecting their own device, browser, network, accounts, credentials and information. The corresponding contractual responsibilities, disclaimers and risk allocations are set out in the Terms and Conditions.

15. Security compromises and future account functionality

If login, account, subscription, payment, synchronisation or cloud functionality is introduced in the future, unforeseen attacks, vulnerabilities, service-provider failures, credential theft, human error and other security incidents may occur despite precautions.

To the fullest extent permitted by law, PDFWoohoo does not warrant that future account information will never be accessed, disclosed, altered, corrupted or lost without authorisation.

PDFWoohoo is intended to operate with limited human supervision. As a result:

a security incident may not be detected immediately;
communications concerning an incident may not be read promptly;
PDFWoohoo may lack sufficient records or access to determine what occurred;
an independent provider may control the relevant system or information;
a detailed investigation may be impractical or impossible; and
PDFWoohoo does not promise to undertake a voluntary forensic investigation or provide individual technical assistance.

Where applicable law imposes a non-excludable duty concerning a known security compromise involving personal information under PDFWoohoo’s control, that legal duty will apply. Nothing in this policy should be interpreted as voluntarily creating obligations beyond those imposed by applicable law.

Users must not delay protective action while waiting for PDFWoohoo to investigate, respond or provide instructions. Related limitations and assumption-of-risk provisions appear in the Terms and Conditions.

16. Your responsibilities

You are responsible for:

deciding freely whether to use the Services;
protecting your device, browser, accounts and credentials;
using suitable security software and applying appropriate updates;
reviewing the browser extensions and software operating on your device;
preventing unauthorised access to your device;
maintaining independent backups of important material;
checking exported files before relying on or distributing them;
ensuring that you have the right and authority to process User Content;
obtaining any consent required from persons whose information appears in User Content;
complying with confidentiality, intellectual-property, privacy, employment, professional and industry obligations applicable to you;
avoiding the processing of unlawful or malicious material;
determining whether browser-based processing is suitable for the confidentiality and risk level of your information;
independently monitoring your own environment for suspicious activity; and
immediately ceasing use if you suspect illicit, malicious, compromised or unsafe activity.

You must not assume that the absence of an intentional file-upload feature protects User Content against risks originating from your device, network, browser, browser extensions, third-party software or conduct.

These responsibilities are additional to the user obligations and prohibited-use provisions in the Terms and Conditions.

17. Intellectual property and ownership of User Content

You retain all ownership and intellectual-property rights that you lawfully hold in your User Content.

Using PDFWoohoo does not transfer ownership of your documents, drawings, designs, images, text, trade secrets, confidential information or other intellectual property to PDFWoohoo.

Because User Content is processed locally in the current application, you do not grant PDFWoohoo a licence to host, analyse, publish, commercialise or use that User Content merely by opening or processing it in the application.

You remain solely responsible for ensuring that your User Content does not infringe another person’s rights.

All rights in the PDFWoohoo name, branding, websites, application code, interfaces, documentation and other PDFWoohoo materials remain reserved to their respective owner, except for third-party software used under its applicable licence.

More detailed provisions concerning User Content, PDFWoohoo intellectual property, copyright, trademarks, permitted use and prohibited copying appear in the Terms and Conditions.

18. Voluntary use and assumption of risk

Use of PDFWoohoo is optional and undertaken of your own free will.

You are not required to use PDFWoohoo to process, convert or manage your files. Alternative software and offline processing methods may be available.

By choosing to use the Services, you acknowledge that:

you have independently decided that the Services are suitable for your intended use;
you understand that client-side processing reduces but does not eliminate risk;
you remain responsible for the security and lawfulness of your User Content;
PDFWoohoo is provided as a substantially autonomous, self-service facility;
the Services may not be actively supervised or monitored;
assistance, investigation or intervention may not be available;
you must stop using the Services if you suspect illicit or unsafe activity; and
you accept the ordinary risks inherent in using browser-based software, third-party libraries and internet-connected systems.

If you do not accept these conditions or the Terms and Conditions, you must not use the Services.

19. Limitation of liability

To the fullest extent permitted by applicable law, your use of the Services and your processing of User Content are undertaken at your own risk.

Although the current application is designed to process User Content locally, PDFWoohoo does not warrant that:

client-side processing will eliminate every possible avenue of disclosure;
third-party scripts, browsers, devices or networks will always operate securely;
the Services will be uninterrupted, fault-free or invulnerable;
User Content will never be lost, corrupted, disclosed or accessed without authorisation;
suspicious activity will be detected, investigated or prevented;
communications will be read or answered;
support or intervention will be available; or
future security incidents or data breaches will never occur.

To the fullest extent permitted by law, PDFWoohoo and its owner, operator, affiliates, licensors, service providers, employees, contractors and representatives will not be liable for indirect, incidental, consequential, exemplary, punitive or special loss arising from:

unauthorised access to, disclosure of, loss of or corruption of User Content;
compromise of a user’s device, browser, network, credentials or local storage;
malicious browser extensions, software or third-party components;
actions or omissions of hosting providers, content-delivery networks or other independent parties;
an unforeseen security incident or data breach affecting future login or account information;
the absence or impracticability of active monitoring, support or investigation;
delayed discovery of an incident;
a communication not being monitored, read or answered;
a user’s decision to process confidential, regulated or sensitive information;
a user’s continued use after suspicious activity becomes apparent; or
a user’s failure to maintain suitable security controls or backups.

This limitation applies whether a claim is framed in contract, delict, negligence, statute or another cause of action, but only to the extent permitted by applicable law.

This section supplements the more detailed disclaimers, warranty exclusions and liability limitations in the Terms and Conditions.

Nothing in this Privacy Policy or the Terms and Conditions excludes liability that cannot lawfully be excluded or removes a mandatory obligation imposed by POPIA, consumer-protection legislation or another applicable law.

20. Indemnity

To the fullest extent permitted by applicable law, you agree to indemnify, defend and hold harmless PDFWoohoo and its owner, operator, affiliates, licensors, service providers, employees, contractors and representatives from claims, liabilities, losses, damages, penalties, costs and reasonable legal expenses arising from or relating to:

your User Content;
your unlawful, negligent or unauthorised use of the Services;
your infringement of another person’s privacy, confidentiality, intellectual-property or other rights;
your processing of personal information without an appropriate legal basis or required authority;
your failure to comply with a contractual, professional, regulatory or legal obligation;
your device, browser, extension, network, credentials or local security being compromised;
information you voluntarily publish, transmit or disclose;
your continued use of the Services after becoming aware of suspected illicit or unsafe activity; or
your breach of this Privacy Policy or the Terms and Conditions.

This indemnity supplements the broader indemnity contained in the Terms and Conditions.

This indemnity does not apply where indemnification cannot lawfully be required.

Nothing in this section removes a non-excludable statutory duty concerning personal information under PDFWoohoo’s possession or control.

21. Your privacy rights

Subject to applicable law, you may have the right to:

ask whether PDFWoohoo holds personal information about you;
request access to that information;
request correction of inaccurate or incomplete information;
request deletion or destruction of information that may no longer lawfully be retained;
object to certain processing;
withdraw consent;
request restriction of processing;
request portability of qualifying information; and
lodge a complaint with a competent privacy regulator.

These rights may be subject to lawful limitations, identity verification, record-retention obligations, practical availability of the relevant information and the rights of other persons.

Because User Content processed by the current application is not intentionally received or stored by PDFWoohoo, PDFWoohoo ordinarily cannot access, retrieve, correct, investigate or delete that User Content for you. You control it through your own device and browser.

22. Communications, requests and complaints

An available contact page or other published contact method may be used to submit privacy-related communications.

However:

contact facilities may not be continuously or regularly monitored;
PDFWoohoo does not operate a continuously staffed support or security department;
messages may not be read or answered promptly;
sending a message does not initiate a guaranteed investigation;
PDFWoohoo may be unable to verify or investigate a reported incident;
PDFWoohoo does not promise a response except where a response is strictly required by applicable law; and
users must not delay their own protective, legal or regulatory action while awaiting a response.

Where applicable law grants you a right to submit a complaint directly to a privacy regulator, you may exercise that right independently.

South African users may contact the Information Regulator of South Africa using the details published on the Regulator’s official website.

If you believe criminal, fraudulent or otherwise unlawful activity is occurring, you should cease using the Services and independently consider contacting an appropriate law-enforcement agency, regulator, cybersecurity professional, legal adviser or service provider. PDFWoohoo does not undertake to make such reports or obtain such assistance on your behalf.

23. Children

The Services are not specifically directed to children.

Children should use the Services only with the involvement and permission of a parent or legal guardian where required by law.

PDFWoohoo does not undertake to actively monitor the age or identity of every visitor. A parent or guardian is responsible for supervising a child’s use of the Services and determining whether the Services are appropriate.

A child’s use of the Services remains subject to the Terms and Conditions.

24. Third-party websites and services

The Services may contain links to or depend upon third-party websites, libraries, infrastructure or services.

PDFWoohoo does not control and is not responsible for the privacy, security, availability, content, monitoring or conduct of independent third parties. Following a link or using a third-party service is subject to that party’s own terms and privacy practices.

PDFWoohoo does not undertake to monitor or investigate third-party services on behalf of users.

If you suspect illicit, malicious or unsafe activity by any third party connected with the Services, you must immediately cease using the affected Service and take independent protective action.

Further provisions concerning external links and third-party risk appear in the Terms and Conditions.

25. Changes to the Services

PDFWoohoo may add, remove, suspend or change functions over time.

Features such as login accounts, cloud storage, subscriptions, payment processing, collaboration, server-side conversion, analytics or synchronisation may require additional collection and processing of personal information.
